Conviction Reversed by Fourth Circuit, Case Remanded for Resentencing

We were pleased last month to consent to a Government motion in United States v. Burney, App. No. 13-4925, confessing a trial error to the U.S. Court of Appeals for the Fourth Circuit. The Fourth Circuit has now agreed, and vacated our client’s conspiracy conviction for insufficient evidence.

We are pleased that the Government recognized this error, and did the right thing. We also congratulate the trial lawyers – Joseph Gilbert and Jennifer Dominguez – for setting the appeal up for this win.
